I have been on a spousal visa since 2009. Went to renew well before it expired in January. Have waited 11 months. Received no notification that decision had been made.This time was REFUSED because my South African partner (who has been divorced since 2009) is still married. A) he divorced in 2009 B) our Cohabitation Agreement was legally drawn up in 2010. In the meantime I have been under 'house arrest' in SA. Am allowed to leave, but will be declared UNDESIRABLE and not allowed to re-enter. Went to appeal against decision. Home Affairs have outsourced all such applications to a private company, Global Visas, who charged R1350 for the privilege. It took them over an hour to put my fingerprints on the system, and I had to pay a further R200 to a woman in another office to fill in my form (she made a lot of errors). Given I was told the original application would take 1 month and it took 11, I have now been told the appeal should take 2 months. I have done the maths. It is totally unacceptable to be refused on false grounds in the first place. Now the appeal has cost more than the original application, and could take longer. In the meantime I could not leave, even if someone in my family died, they told me. As it happens, my daughter is having a baby in the UK and I can't go. Surely this is against constitutional law?
